Terms and Conditions of Use

Welcome to Aurora Hunter. By downloading, accessing, or using the mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these terms, please do not use the application.

1. License and Use of Service

Francesco Livraghi ("Owner") grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for personal, non-commercial purposes.

The App provides forecasts on auroral activity, weather, and location tools. The service is provided "As-Is" and "As Available", without warranties of any kind, express or implied.

2. Safety Disclaimer and Assumption of Risk

WARNING: READ THIS SECTION CAREFULLY.

"Aurora borealis hunting" is an activity that takes place predominantly in nocturnal environments, with freezing temperatures (often below zero), in remote, poorly lit areas, and with potentially dangerous road conditions (ice, snow).

By using the App, you acknowledge and agree that:

  • Assumption of Risk: The user assumes full and total responsibility for their own physical safety and that of their passengers while traveling to the spots suggested by the App.
  • Disclaimer of Liability: The Owner shall not be liable in any way for injuries, hypothermia, traffic accidents, vehicle damage, fines, or any other direct or indirect damage resulting from the aurora observation activity.
  • Caution: The directions provided by the App are purely informational. It is up to the user to evaluate weather and road conditions before embarking on a journey.

3. Data Accuracy and Third Parties

The forecasts shown (KP Index, Solar Wind, Cloud Cover) are calculations based on data provided by third parties (e.g., NOAA, Open-Meteo). While we strive to ensure maximum accuracy:

  • We do not guarantee that the data is error-free or updated in real-time to the second.
  • We do not guarantee the sighting of the aurora: The aurora borealis is an unpredictable natural phenomenon. Even with high indices, a sighting is never guaranteed.
  • The App may contain links to third-party websites or services that are not under our control.

4. User Generated Content (Reports and Photos)

The App allows users to submit sighting reports and upload photographs ("User Content"). By submitting such content:

  • You declare that you are actually in the indicated location and are the author/rights holder of the uploaded photo.
  • You grant the Owner a worldwide, royalty-free, perpetual, and sublicensable license to display, reproduce, and show the report and photo on the App, the official website, and the App's social channels (e.g., Facebook, Instagram) for informational and promotional purposes.
  • You acknowledge that, given the anonymous nature of the service, the Owner will publish such content citing the anonymous ID (e.g., Hunter-XXXXX) or omitting the reference if unavailable.
  • You agree not to upload photos depicting recognizable faces of third parties without consent, or offensive/illegal content.

5. Intellectual Property

All rights, title, and interest in and to the App (including, but not limited to, software, source code, design, logos, text, and graphics) are and remain the exclusive property of Francesco Livraghi.

It is strictly forbidden to copy, modify, distribute, sell, or reverse engineer any part of the App.

Photos uploaded by users remain their property, but the collection and organization of the photo feed within the App constitute a protected intellectual work, for which the Owner holds the curatorship rights.

6. Advertising and Purchases

The App is currently offered under an ad-supported "Freemium" model. We reserve the right to:

  • Change the business model in the future.
  • Introduce paid Premium features (with clear prior communication).

The App uses advertising identifiers (such as the Advertising ID) to show relevant ads, in accordance with our Privacy Policy.

7. Commercial Partnerships and Affiliate Links

The "Aurora Hunter" App acts as an informational showcase and may contain links to third-party services (e.g., local tour operators, hotels, accommodations). The Owner participates in commercial affiliate programs: this means that for some of the services recommended or bookable via links or discount codes in the App, the Owner may earn a commission on qualifying purchases made by users.

The user acknowledges and agrees that:

  • No sales responsibility: Aurora Hunter is not a travel agency or a tour operator. The App does not directly sell or provide tourist services. Any transaction, booking, or payment takes place exclusively on the websites or platforms of third-party partners.
  • Disclaimer on third-party services: The Owner is not responsible for the quality, safety, cancellation policies, or the actual execution of tours, stays, or activities booked through the links provided in the App. Any claim or refund request must be addressed directly to the final service provider.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Owner be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits or revenues, arising from:

  • The use or inability to use the App;
  • Unauthorized access to servers or data;
  • Any bugs, viruses, or trojans transmitted through the App.

9. Changes to the Terms

We reserve the right to modify these Terms at any time. Changes will be effective from the time they are published on this page. Continued use of the App after such modifications constitutes acceptance of the new Terms.

10. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Italian Republic. For any dispute relating to the interpretation or execution of these terms, the Consumer Court shall have exclusive jurisdiction if applicable (Legislative Decree 206/2005), or alternatively the competent Court determined according to current laws.
